TRADEMARK IN INDIA

Brand Registration is the process of securing the brand name, Logo, Image, Slogan, Tag Line or Punch Line of the Business. It is advisable to secure the TM at an early stage in order to avoid the copy cats to take undue advantage of the Brand.

The whole procedure is described as under:-

      TIME DURATION: – The process for securing registration of Brand Registration initiates from search of Brand Registration and in case the mark is available then the application is filed and it takes on an average 5-6 months to get the mark registered. However, if the objection comes then the time is extended to 12 months. However, the legal right starts from Day 1 from the date the application is filed. There is also a period of 4 months given to the third parties to file opposition once the mark is accepted by the department and if no opposition is filed then the Certificate is granted in 6 months or so.

     INFORMATION:-For filing a new Brand Registration Application, we would require the following information and documents from your end:-

1. Name and address of the proprietor.
2. Details of the mark to be registered (whether word mark, logo or device)
3. Goods/services in respect of which the mark is being used/intended to be used ie Class or category.
4. Year of usage since when the mark is being used/intended to be used.
5. Power of Attorney signed by the applicant.

 FEE:-The statutory/ official fee for single application filing the Trade Mark application with the Trade Mark Registry is Rs. 4500.

 VALIDITY: – The Brand Registration if registered owns a validity of ten years from the date of filing the application and is valid whole over INDIA.

  LEGAL RIGHT: – The legal right starts from DAY 1.
