Once the trademark application is filed at the Indian Trademark office, the trademark officer examines the trademark and generates its official and examination report. If the mark is copied or similar to any other mark which is registered or prior to the filed mark then the mark is objected and thus the applicant has to file the reply and file. Once the trademark is published in the Journal the same is in for a duration of 4 months from the date of publication. The third party and third persons can oppose and challenge the trademark by filing the trademark opposition. They have a right to file this anytime within the duration of 4 months from the date of the publication. Once the four months is passed then the opposition date is passed and then no one can file the opposition and thus the mark is enable for registration. No grace period is entitled in the India laws for this time frame. The proper form for this is TMO with fee to be filed.

TRADEMARK RECTIFICATION

Once the mark is registered and no opposition is filed and any third party still have some right on account of time lapsed for not filing the opposition then the third party can file rectification of the trademark and thus can still challenge the copied mark. There is a provision in the trademark act 1999, to file amendment and changes if the applicant wishes to change anything by paying the additional fee to the government and thus can change the details if any  on account of some error or some updates if the applicant wishes to do the same. Trademark is valid for 10 years from the date of application. After that the trademark has to be renewed for another ten years by paying an additional fee of Rs 10000. If the mark is not renewed then there is an additional surcharge to be paid along with the renewal fee as well. The proper form for this is TMR with fee to be filed. There is a provision for getting the certified copies of the registered trademark or application which is pending from the trademark department.
